EU‑Wide Legal Framework

  • Industrial hemp varieties containing up to 0.2 % THC, according to Regulation 1307/2013
  • A ruling by the Court of Justice of the European Union (2020) affirmed that CBD legally produced in one member state cannot be banned by another, except to safeguard public health under proportionate regulation.
  • Since 2019, the European Commission has classified CBD as a “novel food”, meaning that all ingestible CBD products (e.g., oils, edibles) must obtain safety approval via EFSA before they can legally be marketed.
  • As of 2023 updates to the Common Agricultural Policy (CAP), the allowable THC limit for hemp imports has been raised from 0.2 % to 0.3 % in many contexts.
